Terms & Conditions for Advertisers
These Terms & Conditions for Advertisers should be read in conjunction with the General Terms & Conditions for all users. In addition to agreeing to the General Terms & Conditions, Advertisers on www.christiancareer.com.au ("Advertisers") agree to be bound by the following terms and conditions. Advertisers must fully comply with the Human Rights and Equal Opportunity Commission Act 1986 (C'th) and all anti-discrimination and equal opportunity legislation applicable in the State or Territory in which they conduct business. Where an Advertiser has been granted an exemption to comply with the legislation, the exemption number must be included in the advertisement submitted to Christian Career. Media Inc. does not review every advertisement posted to the site. However, we do reserve the right to refuse to publish or withdraw from publication without notice to the Advertiser any advertisement that appears to us to be contrary to law. Media Inc. reserves the right to refuse to publish or withdraw from publication any advertisement from the site for any reason whatsoever. Each Advertiser agrees to indemnify Media Inc. and its officers, employees and agents against all claims, actions, suits, liabilities, costs and expenses incurred on any account by Media Inc. as a result of the publication of or proposed publication of any advertisement by the Advertiser. While Media Inc. makes every reasonable effort to ensure that advertisements posted on the site are free of errors, Media Inc. is not responsible or liable for any errors. Advertisers are entirely responsible for the content of their advertisements and are required to check their advertisements for errors as soon as they are published the site. Media Inc. will make all reasonable efforts to edit any errors brought to our attention as soon as reasonably possible. Media Inc. agrees to use reasonable efforts to publish advertisements in the shortest time possible after an advertisement is submitted. However, Media Inc is not liable for any loss or damage incurred by an Advertiser as a result of any failure or delay in publishing an advertisement. Media Inc. will not be liable for any damage or loss incurred by any third party as a result of any failure on the part of an Advertiser to abide by all applicable laws of Australia or of any other relevant jurisdiction (including but not limited to privacy, copyright and employment laws). Advertisers agree not to ask or require any job candidate to pay any fee or charge or to incur any cost or to pay any money whatsoever to apply for any job advertised on the Christian Career website under any circumstances whatsoever. Advertisers also agree not to use the site in any way to promote or recruit for any pyramid scheme. Advertisers agree not to use the site in any way to send unsolicited commercial email to Job Seekers, either individually or collectively. The site’s functional features may only be used to communicate with job candidates about a specific job for which they have applied. The site’s résumé database may only be used to communicate with candidates who match an Advertiser’s preferences for a specific vacancy. All Advertisers agree to adhere to the principles of truth in advertising set out in the RCSA Code for Professional Practice. Advertisers should only place job advertisements for positions for which they have permission to recruit. Advertisers also agree to comply with the National Privacy Principles set out under the Privacy Amendment (Private Section) Act 2000 (See www.privacy.gov.au for more information on the Australian National Privacy Principles).
Advertisers must ensure that any advertisement posted to the Christian Career website complies with all applicable legislation, regulations, by-laws, ordinances or codes of conduct in all applicable States and Territories of Australia or any other relevant jurisdictions. Advertisers agree to keep Media Inc. and its officers, employees and agents fully indemnified against any costs, expenses, charges, damages or liabilities incurred in relation to any actions or claims brought against it by any third party as a result of an actual or alleged breach of any law, regulation, by-law, ordinance or code of conduct on the part of the Advertiser in relation to posting an advertisement on the site. Advertisers are not permitted to link from SEEK's job application process to any external websites/externally hosted application forms without SEEK's express written approval. Such approval is subject to strict terms and conditions. Advertisers may not assign or transfer any rights and obligations pursuant to this agreement to any other person or entity without the prior written approval of Media Inc. Any change in the effective control of a company shall be deemed an assignment for the purpose of this clause. Advertisers acknowledge and agree that Media Inc. and the Christian Career website act only as a passive intermediary between individuals seeking employment opportunities and prospective employers and that Media Inc. does not vet nor is it responsible for vetting job candidates or any representations they make. Media Inc. is not liable for any loss, costs, damages incurred by an Advertiser as a consequence employing or otherwise engaging any person sourced through the Christian Career website. Advertisers understand and agree that under this agreement the following actions constitute a new/additional job advertisement:
The following changes to a job advertisement do not constitute a new job ad: changes to body copy, ad title, location, work type, industry or occupation category. Only Advertisers who have registered and been approved for résumé search capabilities have access to the candidate résumé database. The information stored on the candidate résumé database is to be used solely for the purpose of identifying candidates whose stated preferences for employment match the job advertisements currently posted on the Christian Career website by the Advertiser. Advertisers must not use or forward a candidate's résumé without the candidate’s permission. Advertisers agree that pursuant to Sections 18K(1)(b) and 18N(1)(b) of the Privacy Act 1988, SEEK may, for the purposes of assessing an Advertiser’s commercial credit application, obtain from either a credit reporting agency or other credit providers, personal credit information about the Advertiser and/or its directors. Advertisers agree that pursuant to Section 18K(1)(h) of the Privacy Act 1988, SEEK may obtain a consumer credit report about the Advertiser from a credit reporting agency for the purposes of collecting overdue payments relating to commercial credit owed by the Advertiser. In compliance with section 53B of the Trade Practices Act 1974 (C'th), Advertisers agree not to mislead job seekers with regards to the availability and nature of employment opportunities being advertised, or any aspect of any employment opportunity being advertised. It is the responsibility of the Advertiser to ensure that ads are posted to the appropriate category. Media Inc. reserves the right to reclassify and reposition an advertisement to another category if it is deemed that the ad in question has been posted to an inappropriate category.
